ARTICLE 2 – SCOPE OF APPLICATION AND ACCEPTANCE OF THE TERMS

These General Terms and Conditions of Sale (GTC) apply to all sales made through the website morel.com to consumers located within the European Union, as well as in the United Kingdom, Switzerland and Norway.

The GTC are accessible at any time on the website.

The Customer declares that they have read and accepted these GTC without reservation prior to placing their order.

Acceptance of the GTC is materialized by ticking a non-pre-ticked checkbox during the checkout process.

Confirmation of the order implies full and unconditional acceptance of these GTC.

 

ARTICLE 3 – PRODUCTS AND PRE-CONTRACTUAL INFORMATION

The products offered for sale are exclusively non-prescription sunglasses, considered fashion accessories.

They:

  • do not constitute medical devices;
  • comply with applicable European regulations;
  • bear the CE marking (PPE Category I);
  • comply with EN ISO 12312-1 standards.

The lenses are not suitable for night driving or for direct observation of the sun.

If the Customer wishes to fit the frame with prescription lenses, they must contact a qualified optician.

Services performed by opticians are independent from MOREL France and remain under their exclusive responsibility.

Products are offered for sale while stocks last.

In accordance with regulations applicable to distance contracts, the Customer is provided, prior to placing an order, with: the essential characteristics of the product, its price, payment and delivery terms, information regarding the right of withdrawal.

This information is displayed on each product page.

Photographs and visuals displayed on the website are not contractually binding. Slight variations in color or appearance may occur depending on the screens used.

Products are supplied with a case included in the packaging.

 

ARTICLE 4 – PRICE

Product prices are indicated including all taxes (VAT included), in accordance with applicable regulations.

Depending on the delivery country selected by the Customer, prices may be displayed:

  • in euros (€), or
  • in the local currency of the country concerned.

The applicable currency is clearly indicated before order confirmation.

Standard delivery is free of charge.

Return shipping costs remain the responsibility of the Customer in accordance with Article 8.

MOREL reserves the right to modify its prices at any time. The price applicable is the one in effect at the time the order is confirmed.

 

ARTICLE 5 – ORDER

Orders are placed exclusively via the website morel.com, without the need to create a customer account.

The Customer undertakes to provide accurate, complete and up-to-date information.

MOREL shall not be held liable for errors in the information provided by the Customer resulting in delivery delays or impossibility of delivery.

The contract language is French. The contract is formed only upon the sending of the order confirmation email by MOREL.

MOREL reserves the right to refuse or cancel any order, particularly in cases of:

  • product unavailability;
  • obvious pricing error;
  • suspected fraud;
  • payment irregularity.

If a product becomes unavailable after the order has been placed, the Customer will be informed and refunded within 14 days.

 

ARTICLE 6 – PAYMENT

Payment is made exclusively by credit card (Visa, Mastercard) via Shopify Payments.

The payment is charged immediately when the order is placed.

As part of fraud prevention, MOREL reserves the right to carry out any necessary verification and request supporting documents before final validation of the order.

No delivery will take place before full payment has been received.

 

ARTICLE 7 – DELIVERY

Delivery is carried out by:

  • In France: Colissimo or Mondial Relay
  • Within the European Union: Chronopost or Mondial Relay depending on the destination country.

Estimated delivery time: 2 to 8 working days.

A shipping confirmation email is sent to the Customer when the order is handed over to the carrier, including a tracking number when available.

MOREL cannot be held responsible for non-receipt of an email due to: an incorrect email address or a technical issue beyond its control.

Risk is transferred to the Customer when they physically take possession of the product.

In the event of parcel loss attributable to the carrier, MOREL will send a replacement product.

An invoice is included inside the parcel.

 

ARTICLE 8 – RIGHT OF WITHDRAWAL AND RETURNS

In accordance with European legislation, the Customer has fourteen (14) calendar days from receipt of the product to exercise their right of withdrawal.
The Customer may exercise this right using the withdrawal form in Annex 1 and by sending the request to:

Upon receipt of the request, MOREL will communicate:

  • the exact amount of applicable return shipping costs;
  • a return label via its partner carriers.

The Customer must explicitly confirm their intention to return the product at their own expense before shipment.

Return shipping costs are entirely borne by the Customer. They will be deducted from the refund of the order.

The Customer may use the label provided by MOREL, or choose another carrier at their own expense and responsibility.

Products must be returned in their original condition, with their packaging where possible.

The Customer is only liable for any decrease in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

In accordance with Article 13 of Directive 2011/83/EU, the refund will be made using the same payment method used for the order, within a maximum of 14 days after the recovery of the product by MOREL, or the proof of shipment provided by the Customer.

 

ARTICLE 9 – LEGAL WARRANTY

The Customer benefits from the legal guarantee of conformity provided by the legislation applicable in their country of residence for a minimum period of two (2) years from delivery.

Under this legal guarantee, in the event of non-conformity, the consumer is entitled to have the product repaired or replaced free of charge, within a reasonable time and without significant inconvenience. If repair or replacement is impossible or disproportionate, the consumer may obtain a price reduction or termination of the contract. This legal guarantee applies independently of any commercial warranty that may be offered.

Additional information applicable exclusively to France is provided in Annex 2.

If a longer legal warranty applies under the law of the Customer’s country, it shall prevail accordingly.

The warranty does not cover defects resulting from:

  • abnormal use;
  • impact or dropping;
  • modification;
  • exposure to extreme conditions;
  • normal wear and tear.

No additional commercial warranty is provided.

ARTICLE 10 – LIABILITY

The products sold are non-prescription sunglasses.

MOREL cannot be held liable for:

  • improper use of the product;
  • use contrary to recommendations;
  • use for night driving;
  • damage caused by shock or improper handling;
  • non-performance or delay due to force majeure, as defined by Article 1218 of the French Civil Code or applicable legislation in the Customer’s country.

 

ARTICLE 11 – PERSONAL DATA

Personal data is processed in accordance with the Privacy Policy available on morel.com.

 

ARTICLE 12 – COMPLAINTS AND AMICABLE RESOLUTION

In the event of a complaint, the Customer is invited to contact customer service at: france@morel.com

MOREL undertakes to seek an amicable solution first.

If no agreement is reached, the Customer may contact the mediator mentioned below or initiate legal proceedings.

 

ARTICLE 13 – MEDIATION

In accordance with the French Consumer Code, the Customer may use a consumer mediation service free of charge to resolve disputes amicably. The consumer must first submit a written complaint to the seller’s customer service. If no amicable agreement is reached, the consumer may contact the following mediator:

ARTICLE 14 – INTELLECTUAL PROPERTY

All elements of the website morel.com (texts, images, logos, trademarks, graphics) are protected by intellectual property law.

Any total or partial reproduction is strictly prohibited without prior authorization.

 

ARTICLE 15 – PROVISIONS OUTSIDE THE EUROPEAN UNION

15.1 – United Kingdom

For deliveries to the United Kingdom, the mandatory provisions of the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 apply to UK consumers. Consumers benefit in particular from:

  • a 14-day withdrawal period;
  • the right to reject faulty goods within 30 days;
  • the right to repair or replacement under legal warranty;
  • the possibility to bring a claim within 6 years (5 years in Scotland) if the defect existed at the time of delivery.

 

15.2 – Switzerland

For deliveries to Switzerland, the mandatory provisions of the Swiss Code of Obligations apply.

  • Withdrawal rights are not mandatory under Swiss law.
  • The 14-day return period provided in these GTC therefore constitutes a commercial guarantee offered voluntarily by MOREL.
  • The legal warranty for defects is two (2) years from delivery.

 

15.3 – Norway

For deliveries to Norway, mandatory provisions of Norwegian consumer law apply.

Consumers benefit from:

  • a 14-day withdrawal period;
  • a legal warranty of at least two (2) years, which may extend to five (5) years for goods intended to last significantly.

 

ARTICLE 16 – APPLICABLE LAW

These GTC are governed by French law.

However, the Customer benefits from the mandatory provisions of the law of their country of residence within the European Union.
In the event of dispute, the competent courts will be those of the consumer’s place of residence, in accordance with Regulation (EU) No. 1215/2012.

 

ARTICLE 17 – WEBSITE ACCESSIBILITY

MOREL endeavors to ensure access to the website 24 hours a day, 7 days a week. However, it cannot be held liable for temporary interruptions due to maintenance, technical updates or events beyond its control. Such interruptions may occur with or without prior notice.

 

ARTICLE 18 – MODIFICATION OF THE TERMS

MOREL reserves the right to modify these GTC at any time. The applicable terms are those in force at the date of order confirmation.

 

ARTICLE 19 – ENTIRE AGREEMENT

These GTC express the entire obligations of the parties. If any clause is declared invalid, the remaining provisions shall remain applicable.
